Terms of Service

Welcome to NovaCanvas. By accessing our website at novacanvas.studio or engaging our creative services, you agree to be bound by these Terms of Service. Please read them carefully before using our site or commissioning any work.

1. Services

NovaCanvas provides creative design and development services including, but not limited to, UI/UX design, web development, brand identity, motion graphics, and consulting. The specific scope, deliverables, and timeline for any project will be outlined in a separate written agreement or project proposal.

All services are provided on a freelance basis. We reserve the right to decline any project that does not align with our expertise or values.

2. Payments & Fees

Project fees are agreed upon before work begins. A non-refundable deposit (typically 50% of the total project cost) is required to initiate work, unless otherwise stated in the project agreement. The remaining balance is due upon completion and before final deliverables are released.

For ongoing or retainer-based work, payment terms will be specified in the agreement. Late payments may incur additional charges or project suspension.

3. Intellectual Property

Upon full payment, the client receives full ownership of the final deliverables created specifically for the project. However, NovaCanvas retains the right to:

  • Display the work in our portfolio, on our website, and in marketing materials (unless otherwise agreed upon in writing).
  • Retain ownership of any preliminary concepts, unused drafts, and proprietary tools or templates developed during the project.
  • Be credited as the creator of the work (where appropriate).

The client guarantees that any materials provided to NovaCanvas (such as images, text, or logos) do not infringe on third-party intellectual property rights.

4. Revisions & Approvals

Each project includes a set number of revision rounds as defined in the project agreement. Additional revisions beyond that scope will be billed at our hourly rate. Timely client feedback is essential; delays in providing feedback may affect the project timeline.

5. Project Timeline & Delays

We make every effort to meet agreed-upon deadlines. However, delays caused by client inaction, scope changes, or force majeure events may extend the timeline. NovaCanvas is not liable for consequences arising from such delays.

6. Termination

Either party may terminate a project with written notice. If the client terminates the project, they are responsible for payment for all work completed up to the termination date, including any non-refundable deposits. NovaCanvas reserves the right to terminate a project if the client breaches these terms or engages in inappropriate conduct.

7. Limitation of Liability

NovaCanvas provides creative services on an "as-is" basis. We are not liable for any indirect, incidental, or consequential damages arising from the use of our work or website. Our total liability for any claim related to our services is limited to the amount paid by the client for that specific project.

8. Website Use

When using our website, you agree not to:

  • Copy, modify, or distribute any content without permission.
  • Use the site for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to any part of the site.

We reserve the right to modify or discontinue our website at any time without notice.

9. Privacy

Your use of our website and services is also governed by our Privacy Policy, which explains how we collect and handle personal data.

10. Changes to These Terms

We may update these Terms of Service from time to time. The latest version will always be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the new terms.
